What happens to the rental property in the event of a death?
The death of a tenant raises not only emotional questions, but also legal ones, especially with regard to the rental property. Many relatives mistakenly assume that the tenancy automatically ends with the death of the tenant. In fact, however, there are clear legal regulations that must be observed in order to avoid possible financial obligations.

The tenancy does not end automatically

According to Swiss law (Article 266i OR), a tenancy does not automatically end with the death of the tenant. The heirs enter into the tenancy and must terminate it in order to end it. If they do not do so in time, rental costs may continue to arise, which must be borne by the heirs. However, the heirs have the right to terminate the tenancy with the statutory notice period of three months (for apartments) or six months (for business premises) to the next statutory termination date.
